Welcome to Cheph. These Terms of Use ("Terms") govern your access to and use of the Cheph website, services, meal ordering platform, and related communications (collectively, the "Services"). By accessing or using our Services, creating an account, placing an order, or opting in to receive communications from us, you agree to be bound by these Terms.
If you do not agree to these Terms, please do not use our Services.
1. Eligibility
You must be at least 18 years old and reside in the United States to use our Services. By creating an account or placing an order, you represent and warrant that you meet these requirements.
2. Account Registration
To place orders through Cheph, you may be required to create an account using a valid email address or phone number.
You agree to provide accurate, complete, and current information and to update such information as necessary. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
Cheph reserves the right to suspend or terminate accounts that contain inaccurate information or are used in violation of these Terms.
3. Services
Cheph provides chef-prepared meal prep services, including meal ordering, local delivery, and customer pickup options.
Menu offerings, pricing, ingredients, delivery areas, pickup locations, ordering deadlines, and service availability may change at any time without notice.
Cheph reserves the right to refuse, limit, modify, or cancel orders at its sole discretion.
4. Orders and Payment
All prices are listed in U.S. dollars.
By placing an order, you agree to pay all applicable charges, including taxes, delivery fees, and any other fees disclosed during checkout.
Payments are processed through third-party payment providers. Cheph does not store complete payment card information.
An order is not considered accepted until payment has been successfully processed and an order confirmation has been issued.
5. Delivery and Pickup
Cheph offers local delivery and customer pickup options within designated service areas.
Customers are responsible for providing accurate delivery information and ensuring that meals can be safely delivered to the designated location.
Cheph is not responsible for failed or delayed deliveries resulting from inaccurate customer information, inaccessible delivery locations, severe weather, traffic conditions, or other circumstances beyond our reasonable control.
For pickup orders, customers are responsible for collecting their meals during the designated pickup window.
Once meals are delivered or picked up, responsibility for the meals transfers to the customer. Customers are responsible for promptly refrigerating meals and following any provided storage and reheating instructions.
6. Order Changes, Cancellations, and Refunds
Because our meals are prepared to order and contain perishable ingredients, orders may only be modified or canceled before the applicable weekly ordering deadline.
After an order has entered preparation, cancellations, refunds, and exchanges are generally not available except where required by law.
If you experience an issue with your order, including missing items, damaged meals, incorrect items, or quality concerns, please contact us within 24 hours of delivery or pickup.
Cheph may, at its sole discretion, offer a replacement, store credit, partial refund, or full refund depending on the circumstances.
7. Allergies and Dietary Information
Cheph strives to provide accurate ingredient and nutritional information whenever possible.
However, meals may be prepared in facilities or environments where common allergens are present, including but not limited to milk, eggs, fish, shellfish, tree nuts, peanuts, wheat, soy, and sesame.
Customers with food allergies or dietary restrictions are responsible for reviewing ingredient information and contacting us with any questions before placing an order.
Cheph cannot guarantee that any meal is completely free from allergens or cross-contamination.
8. SMS Text Messaging Program
By providing your mobile phone number and affirmatively opting in through our website, account registration, checkout process, or another authorized method, you consent to receive text messages from Cheph.
These messages may include:

Order confirmations

Delivery updates

Account notifications

Customer service communications
Message frequency varies but is generally up to two messages per week, in addition to transactional messages related to your orders or account activity.
Consent to receive marketing text messages is not a condition of purchase.
Message and data rates may apply. Check with your mobile carrier for details regarding your messaging plan.
You may opt out of marketing text messages at any time by replying STOP to any text message. After opting out, you may receive a final confirmation message.
For assistance, reply HELP to any text message or contact us using the information provided below.
Wireless carriers are not liable for delayed or undelivered messages.
By participating in our SMS program, you acknowledge that messages may be sent using automated technology where permitted by applicable law.
9. Intellectual Property
All content available through the Services, including text, graphics, logos, images, recipes, menus, branding, software, and website design, is owned by or licensed to Cheph and is protected by intellectual property laws.
You may not reproduce, distribute, modify, display, publish, sell, or otherwise use any content from the Services without prior written permission from Cheph.

11. Disclaimer of Warranties
The Services and all content are provided on an "as is" and "as available" basis.
To the fullest extent permitted by law, Cheph disclaims all warranties, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
Cheph does not guarantee that the Services will be uninterrupted, secure, or error-free.
12. Limitation of Liability
To the maximum extent permitted by law, Cheph and its owners, employees, contractors, affiliates, and representatives shall not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages arising from or related to the use of the Services.
In no event shall Cheph's total liability exceed the amount paid by you to Cheph during the twelve (12) months preceding the event giving rise to the claim.
13. Indemnification
You agree to indemnify, defend, and hold harmless Cheph and its owners, employees, contractors, affiliates, and representatives from and against any claims, liabilities, damages, losses, costs, and expenses arising from your violation of these Terms or misuse of the Services.
14. Privacy
Your use of the Services is also governed by our Privacy Policy, which explains how we collect, use, and protect your information.
15. Changes to These Terms
Cheph may update these Terms from time to time.
Updated versions will be posted on this page with a revised effective date. Continued use of the Services after changes become effective constitutes acceptance of the revised Terms.
16. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Colorado, without regard to conflict of law principles.
Any dispute arising out of or relating to these Terms or the Services shall be resolved in the state or federal courts located within Colorado, and you consent to the jurisdiction of those courts.
